Terms of booking
[TBC legal review]
These terms apply to private chef, private dining, cooking masterclass and event services provided by From Scratch by Hemi [TBC legal name and address] (“the chef”, “we”). By paying a deposit, you (“the client”) accept them. They do not affect your statutory rights as a consumer.
1. Quotes
A quote is valid for 14 days from the date we send it. Prices depend on the menu, guest numbers, date and location. After 14 days, we may update the price or may no longer have the date available.
2. Booking and deposit
A booking is confirmed only when we receive a deposit of [TBC]% of the total and send you written confirmation. Until then, the date is not held.
3. Payment
The balance is due 7 days before the event. Corporate clients may pay on invoice by agreement. Prices for corporate services are shown plus VAT. We may refuse to attend if the balance is unpaid.
4. Cancellation by the client
Please tell us in writing. The following applies.
| Notice before the event | What is charged |
|---|---|
| More than 14 days | Deposit retained |
| 7 to 14 days | 50% of the total |
| Less than 7 days | 100% of the total |
These sums reflect ingredients ordered, preparation and the date we could not offer to others.
5. Rescheduling
You may reschedule once at no charge if you give at least 14 days’ notice, subject to our availability. Further changes, or changes with less notice, are treated as a cancellation.
6. Guest numbers
You may change the number of guests up to 7 days before the event. We will adjust the price. After that, the number confirmed at 7 days is the number charged, even if fewer people attend. Extra guests may be accommodated if the menu and space allow.
7. Kitchen and venue
For events at your home or venue, you agree to provide:
- safe, clean access to the kitchen or cooking area
- a working hob, oven (if the menu needs it), sink with hot water and electrical sockets
- sufficient table space for the class or service
- parking or a loading point near the property, or reimbursement of reasonable parking, congestion charge and travel costs where applicable
We may decline to cook if the space is unsafe or unsuitable, in which case the cancellation terms may apply.
8. Allergens and dietary needs
You must tell us about all allergies, intolerances and dietary requirements at least 7 days before the event, for every guest. We design the menu around the information you give us. Our kitchens, and yours, may handle nuts, gluten, dairy, eggs and other allergens, so we cannot guarantee an allergen-free environment. We are not responsible for reactions caused by information not given in time.
The chef holds a Level 2 Food Hygiene certificate [TBC] and public liability insurance [TBC]. A copy is available on request.
9. Alcohol
We do not sell alcohol. You provide any drinks for your guests and are responsible for their service. We may stop a class or service if someone’s behaviour becomes unsafe.
10. Damage and safety
We take care of your property. Please report any damage during the event or within 24 hours so we can deal with it promptly. You are responsible for damage caused by you or your guests. Guests take part in hands-on classes at their own risk and should follow safety instructions, especially around knives, heat and hot water.
11. Photography
We may take photos or short videos at events for our website and social media. We will not show identifiable guests without their consent. Tell us before the event, or on the day, if you or any guest does not want to be photographed, and we will respect that.
12. Force majeure
Neither side is liable for failing to perform because of events beyond reasonable control, such as severe illness of the chef, transport strikes, extreme weather, fire, flood or public health restrictions. If we cannot attend, we will offer a new date or refund payments made for the cancelled event.
13. Our liability
Nothing here limits liability for death or personal injury caused by negligence, fraud, or anything the law does not allow us to limit. Otherwise, our liability is limited to the amount you paid for the event.
14. Complaints
If something is not right, tell us within 7 days of the event at hi@hemicastillo.com [TBC]. We will respond within 5 working days and try to put it right.
15. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, though if you live in Scotland or Northern Ireland you may bring proceedings in your home courts.
